NAVISERA — TERMS & CONDITIONS

AGREEMENT TO TERMS

These Terms and Conditions ("Terms") govern your use of the Navisera website and the purchase of any voyage or service offered by Navisera ("we", "our", "us"). By accessing our site, making an enquiry, or booking a voyage, you agree to be bound by these Terms. If you do not agree, please do not use our services.

BOOKINGS & RESERVATIONS

2.1 How to Book

Voyage bookings may be made via our website, or direct communication with a Navisera representative. A booking is considered confirmed only upon receipt of a signed booking form (where applicable) and payment of the required deposit.

2.2 Deposit & Payment

A non-refundable deposit of 30% of the total voyage cost is required to secure your place
The remaining balance is due no later than 60 days prior to the departure date
Bookings made within 60 days of departure require payment in full at the time of booking
Accepted payment methods will be communicated at the time of booking

2.3 Pricing

All prices are quoted in the currency specified at the time of booking and are subject to change until a booking is confirmed. Navisera reserves the right to correct any pricing errors. Prices include the inclusions stated in the voyage description and exclude items noted as additional.

CANCELLATIONS & REFUNDS

3.1 Cancellation by You


All cancellations must be submitted in writing to naviserawellness@gmail.com. The following cancellation fees apply:

More than 90 days before departure: loss of deposit only
60-90 days before departure: 50% of total voyage cost
30-59 days before departure: 75% of total voyage cost
Fewer than 30 days before departure: 100% of total voyage cost (no refund)

We strongly recommend purchasing comprehensive travel insurance that includes cancellation coverage.

3.2 Cancellation by Navisera

Navisera reserves the right to cancel any voyage due to insufficient bookings, adverse weather conditions, vessel issues, or circumstances beyond our reasonable control. In the event of cancellation by Navisera, you will be offered a full refund or the option to transfer your booking to a future voyage. Navisera will not be liable for any additional costs incurred by guests, including flights or accommodation.

3.3 Itinerary Changes

Navisera reserves the right to modify voyage itineraries at any time for reasons of safety, weather, or force majeure. Every effort will be made to deliver the advertised experience, but specific ports, anchorages, or activities cannot be guaranteed.

TRAVEL INSURANCE

Comprehensive travel insurance is strongly recommended for all guests. This should include, at minimum, coverage for: trip cancellation and interruption, medical expenses and evacuation, loss or damage to personal belongings, and personal liability. Navisera accepts no responsibility for losses that would have been covered by adequate travel insurance.

HEALTH, FITNESS & RESPONSIBILITY

5.1 Health Declaration

By booking with Navisera, you confirm that you are in good general health and physically capable of participating in a sailing voyage. You agree to disclose any medical conditions, allergies, dietary requirements, or physical limitations that may affect your safety or the safety of others aboard. This information will be treated with strict confidentiality.

5.2 Personal Responsibility

Guests participate in all activities at their own risk. You are responsible for your own decisions, actions, and wellbeing aboard. Navisera, its crew, and any contractors accept no liability for injury, illness, loss, or damage arising from your participation in voyage activities unless directly caused by our proven negligence.

5.3 Conduct

Guests are expected to treat fellow guests, crew, and the natural environment with respect. Navisera reserves the right to disembark any guest whose conduct is deemed dangerous, disruptive, or incompatible with the spirit of the voyage, without refund.

FORCE MAJEURE

Navisera shall not be liable for any failure or delay in performance arising from causes beyond our reasonable control, including but not limited to: acts of God, extreme weather, pandemics, government actions, port closures, vessel malfunction, or civil unrest. In such circumstances, Navisera will make every reasonable effort to offer an alternative or partial remedy.

INTELLECTUAL PROPERTY

All content on the Navisera website — including text and logo — is the intellectual property of Navisera and may not be reproduced, distributed, or used without prior written consent. The Navisera name and logo are protected trademarks.

PHOTOGRAPHY & MEDIA

Navisera may capture photographs or video footage during voyages for marketing and promotional purposes. By booking a voyage, you grant Navisera permission to use your likeness in such materials, unless you notify us in writing prior to departure that you do not consent. Guest-captured images of Navisera voyages shared publicly on social media are welcomed, with credit appreciated.

LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Navisera's total liability to you for any claim arising from these Terms or your voyage shall not exceed the total amount paid by you for the voyage in question. We are not liable for indirect, incidental, or consequential losses.

GOVERNING LAW

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Navisera is registered. Any disputes arising shall be subject to the exclusive jurisdiction of the courts of that jurisdiction.

AMENDMENTS

Navisera reserves the right to update these Terms at any time. Updated Terms will be posted on our website with a revised effective date. Continued use of our services following any changes constitutes acceptance of the revised Terms.

SEVERABILITY

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
